Terms of Use

The terms that govern access to and use of the Voltnir website and customer portal. They cover the Portal — your account, dashboards, and documentation — and not the Voltnir trading software itself, which is licensed separately.

These Terms of Use (“Terms”) govern access to and use of the Voltnir website and customer portal at voltnir.io, including account registration, dashboards, documentation, and any related web-based tools (the “Portal”), operated by Voltnir B.V., a private limited company (besloten vennootschap) incorporated under the laws of the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 42141121, registered office at Salland 1, 1948 RE Beverwijk, Netherlands (“Voltnir,” “we,” “us”).

These Terms apply to your use of the Portal only. They do not govern your use of the Voltnir trading middleware software itself — that is governed by a separate License and Subscription Agreement entered into when you subscribe to the Service.

By creating a Portal account, you agree to these Terms. If you do not agree, do not create an account.

1 · Eligibility

You must be at least 18 years old and have authority to act on behalf of any company you represent to create a Portal account.

2 · Your account

You must provide accurate information when registering and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@voltnir.io if you suspect unauthorized access.

We may suspend or terminate Portal access if information provided is false, your use violates these Terms, or we reasonably believe your account poses a security risk.

3 · Purpose of the Portal

The Portal is provided to let prospective and existing customers browse information about Voltnir, request access, evaluate the product, manage their account, and (where applicable) access documentation and support. Creating a Portal account does not, by itself, grant you any license to use the Voltnir software or Service — that requires a separate signed License and Subscription Agreement and, where applicable, payment of fees.

4 · Acceptable use

You will not:

  • Use the Portal for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to any part of the Portal, other accounts, or our systems;
  • Scrape, crawl, or harvest data from the Portal by automated means without our written consent;
  • Share your account credentials with, or transfer your account to, any third party;
  • Interfere with or disrupt the integrity or performance of the Portal;
  • Upload or transmit any malicious code.

5 · Intellectual property

The Portal, including its design, text, graphics, and underlying code, is owned by Voltnir or its licensors and protected by intellectual property laws. Nothing in these Terms grants you any right to use Voltnir's trademarks, logos, or branding without prior written consent.

6 · Data protection

Our collection and use of personal data through the Portal is described in our Privacy Policy. By creating an account, you agree to receive service-related communications (e.g. security notices, account confirmations) necessary to operate the Portal. Marketing communications are only sent if you separately opt in, and you may withdraw that consent at any time.

7 · Third-party links

The Portal may link to third-party websites or services not controlled by Voltnir. We are not responsible for the content or practices of any linked third-party site.

8 · Disclaimers

The Portal is provided “as is” and “as available.” We do not warrant that the Portal will be uninterrupted, secure, or error-free. Nothing on the Portal constitutes trading, investment, financial, or legal advice.

9 · Limitation of liability

To the maximum extent permitted by law, Voltnir's liability arising from your use of the Portal (as distinct from the Service itself, which is governed separately) is limited to direct damages, and Voltnir will not be liable for indirect, incidental, or consequential damages arising from Portal use. Nothing in this section limits or excludes liability for intent (opzet) or gross negligence (bewuste roekeloosheid) on the part of Voltnir, or any other liability that cannot be limited or excluded under Dutch law.

10 · Business use only

The Portal is intended for use by businesses and professionals, not consumers acting for purposes outside a trade, business, or profession. By creating an account, you confirm you are acting in a business or professional capacity. If Dutch or other mandatory consumer protection law nonetheless applies to your use of the Portal, the provisions of these Terms apply only to the extent permitted by that law.

11 · Termination

We may suspend or terminate your Portal account at any time for violation of these Terms, or on reasonable notice for any other reason. You may close your account at any time from the portal's account settings, or by contacting support@voltnir.io.

12 · Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a new “Last updated” date. Continued use of the Portal after changes take effect constitutes acceptance. Where a change is material — such as a change affecting your rights, liability, or the scope of the Portal — we will provide at least 14 days' notice via the email associated with your account before it takes effect.

13 · Miscellaneous

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be replaced with a valid provision that most closely reflects its original intent.

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Voltnir regarding use of the Portal, and supersede any prior representations regarding the Portal. They do not govern use of the Service, which is subject to a separate License and Subscription Agreement.

No waiver. Failure by Voltnir to enforce any provision of these Terms is not a waiver of that provision or any other.

Assignment. Voltnir may assign or transfer these Terms, in whole or in part, without your consent, including in connection with a merger, acquisition, or sale of assets. You may not assign your account or these Terms without Voltnir's prior written consent.

Notices. Legal notices to Voltnir must be sent to legal@voltnir.io or to the registered address in section 15. Notices to you will be sent to the email address associated with your account.

14 · Governing law

These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the exclusive jurisdiction of the competent Dutch court for Voltnir's registered seat, unless mandatory law provides otherwise.
